The best way to get familiar with the all of the different laws is to visit the Wine Institute direct shipping portal. When you click on a state, you can see the rules for both offsite and onsite sales. On the state detail pages, we also show the reporting requirements with links to the reporting forms. Remember that all wine club, wine future, Internet, mail, phone and fax orders should be considered offsite transactions. Only orders that took place while the customer was physically present at the winery and where the wine inventory was on hand (no future or club orders) should be considered onsite transactions. Gifts are generally allowed under the wine shipping rules of the recipient's state. If you take an order with multiple gift destinations, you much follow the rules of each of the destination states.

Another great resource is Corbin Houchin's Wine Distribution Notes. Recommended reading for sure. Also, be sure to subscribe to the ShipCompliant Blog for running commentary and analysis from industry experts.

Of course, if you are a ShipCompliant user, we'll handle all of the madness for you!

The following was an attendee question from the ShipCompliant Virtual Seminar held on October 26th, 2007:
Differing laws/regulations/restrictions/guidelines regarding shipping directly to consumers who purchase our wine in person (on site), telephone orders, internet orders from our websites, and regular, scheduled Wine Club shipments. So confusing...each state is different. Reporting guidelines when shipping to consumers whose billing address (or purchaser) is in one state but shipping to a consumer in a different state.
